Terms and Conditions Advantage Holidays Villas

1. GENERAL

All bookings are made with Advantage Holiday's Villas.com acting as an agent on behalf of the owners/management of the properties featured in the Advantage Holiday's Villas.com website. The submission of a booking form is taken as confirmation of acceptance of the following conditions along with the contract of the villa booked for.

2. BOOKINGS

2.1 Provisional Confirmation of Availability

Upon receipt of a request for availability, the applicable villa rates and the amount of deposit required will be confirmed. Bookings are on a 'first-come, first-served' basis and one has to consider that most villas have a minimum number of nights. A booking will be held confirmed once the initial deposit has been paid.

2.2 Initial Deposit

An initial deposit of 30% of the villa rental must be paid before the booking is confirmed and a contract comes into existence. No contract will exist with Advantage Holiday's Villas until the funds and the signed booking form has been received and accepted by Advantage Holiday's Villas. If funds are not received within 5 banking days the reservation shall be deemed as being cancelled. Should the booking be cancelled, cancellation charges will become payable in accordance with cancellation paragraph hereinafter.

Advantage Holiday's Villas doesn’t accept any payment until your reservations have been confirmed and you have received our invoice. In case of any payment made before reception of our invoice that would need to be refunded, less any bank transfer charges.

2.3 Payment of the outstanding balance

Payment of the outstanding balance must be paid at least 30 days before the day of arrival. If Advantage Holiday's Villas does not receive the balance by the due date, Advantage Holiday's Villas reserves the right to cancel the booking and cancellation charges will apply. If the booking is within 30 days of the arrival, the whole cost of the villa rental shall be due at the time of booking.

3 CANCELLATION AND AMENDMENTS TO RESERVATION

If it becomes necessary to cancel all or any part of the booking, Advantage Holiday's Villas must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. The following cancellation charges will be payable depending on when the notification of the cancellation is received in writing:
60 days or more before arrival date: Deposit returned.
30 to 60 days before the arrival date: Advantage Holiday's Villas keeps the deposit.
Within 30 days of arrival date: All rental payments are forfeited.
The above cancellation charges also apply if Advantage Holiday's Villas cancels the booking due to non-payment of the balance. Any change to the original reservation is subject to the approval of Advantage Holiday's Villas.

4 ALTERATIONS AND CANCELLATIONS BY ADVANTAGE HOLIDAY'S VILLAS

Though it is unlikely that Advantage Holiday's Villas will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the Villa, Advantage Holiday's Villas shall reserve the right to cancel the reservation. For example, but not inclusive, if the property is damaged or rendered unusable Advantage Holiday's Villas will endeavour to locate an alternative property for the period required but no guarantee is given that this can be done. However, if this is not possible, or you do not wish to be transferred, Advantage Holiday's Villas will cancel the booking and refund in full, less any bank transfer charges, the amount paid to Advantage Holidays Villa's. Advantage Holidays Villas shall not be liable for any further obligations or claims by the client.

5 INVENTORIES OF FIXTURES

At the arrival of the guests, a valued inventory of fixtures will be signed by the parties. In case of degradation or loss of any item, Advantage Holiday's Villas will claim the repayment in full. A guarantee of 10.000 THB (Ten thousand) will be paid in cash to Advantage Holiday's Villas, in exchange of a receipt, for covering the cost of any damage or breakage, and
paid back the day of the departure.

The person signing the contract is responsible for the correct and appropriate behaviour of the guests. If any member of the party does not behave in such manner, Advantage Holiday's Villas may at their absolute discretion asks the offending guest to vacate the villa forthwith.

6 RATES

Villa rental rates quoted by Advantage Holiday's Villas are on a per night basis and are quoted in THB and before tax.

Rates quoted allow for maximum occupancy of the villa as shown on the web site. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes.

Advantage Holiday's Villas is able to put some ancillary services at the guest’s disposal, paid according to Service’s Rate.

7 ARRIVAL & DEPARTURE TIMES

Guests should assume the Check-in time is after at 2 o'clock in the afternoon, and checkout time is prior to 12 noon, unless otherwise agreed.

8 COMPLAINTS

Advantage Holiday's Villas does not accept responsibility for the breakdown of the supply of water, or electricity, or of filtration systems, though we will use our best endeavours to arrange for any such problems to be solved quickly. Any complaints must be notified to Advantage Holiday's Villas manager within 24 hours of the occurrence-giving rise to the complaint.

9 COMPETENCES
These clauses apply to the rent of all the villas except as otherwise provided, which is explicitly stipulated on the invoice.

These conditions and any contract to which they apply are governed in all respects by Thai law and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
